We are Hot Tub Sanctuary (“Company,” “we,” “us,” or “our”). We operate the website https://hottubsanctuary.com (the “Site”), as well as any other related products and services that refer or link to these Legal Terms (collectively, the “Services”).

1. OUR SERVICES

Information on the Services is not intended for distribution to or use by any person or entity in any jurisdiction where such distribution or use would be contrary to law or regulation or would subject us to any registration requirement. By using the Services, you represent and warrant that you have legal capacity and agree to comply with these Terms, and that any information you provide is true, accurate, current, and complete. We may suspend or terminate access if information is inaccurate or these Terms are violated.

4. USER REGISTRATION

You may be required to register an account. Keep your password confidential and accept responsibility for all use of your account.

5. PRODUCTS

We strive to display product colors, features, specifications, and details accurately, but cannot guarantee your device’s display reflects actual products. Products may be limited in quantity, discontinued, or unavailable. Prices may change at any time.

6. PURCHASES AND PAYMENT

You agree to provide current, complete, and accurate purchase and account information for all transactions, and to promptly update such information (e.g., email, payment method, card expiration). Sales tax is added as required by law. All payments are in USD.

You authorize us to charge your selected payment method for your order total (including shipping and applicable taxes/fees) at the time of purchase. We may refuse or cancel any order, limit quantities per person/household/order, or limit orders that appear to be placed by resellers or distributors.

7. RETURN POLICY

Please review our Return Policy prior to purchase.

8. PROHIBITED ACTIVITIES

You may not use the Services for purposes other than those for which we make them available. Prohibited conduct includes, without limitation: data scraping; fraud; security circumvention; harassment; unlawful use; uploading malware; automated use (bots/scrapers) without permission; impersonation; reverse engineering (except as permitted by law); collecting user data for unsolicited communications; and any activity that competes with or harms the Services.

9. USER GENERATED CONTRIBUTIONS

If you submit content (e.g., reviews, comments, suggestions) (“Contributions”): you warrant you have rights to do so; your Contributions are lawful, non-infringing, and non-confidential; and you are solely responsible for them.

10. CONTRIBUTION LICENSE

By submitting Contributions, you grant us a worldwide, royalty-free, perpetual, sublicensable license to use, reproduce, modify, translate, transmit, display, and distribute such Contributions in any media, for any lawful purpose. You retain ownership of your Contributions.

11. GUIDELINES FOR REVIEWS

Reviews must reflect first-hand experiences, avoid offensive or discriminatory language, avoid references to illegal activity, and be truthful and not misleading. We may accept, reject, or remove reviews at our discretion.

12. SERVICES MANAGEMENT

We may monitor the Services for violations, take legal action, restrict or disable content, remove excessive/burdensome files, and otherwise manage the Services to protect our rights and ensure proper functioning.

13. PRIVACY POLICY

We care about data privacy and security. Please review our Privacy Policy. By using the Services, you agree to it. Our Services are hosted in the United States; by using them from another region, you consent to transfer and processing in the United States.

14. TERM AND TERMINATION

These Terms remain in effect while you use the Services. We may suspend or terminate access to the Services at any time, without notice, for any reason, including violation of these Terms or applicable law.

15. MODIFICATIONS AND INTERRUPTIONS

We may change, modify, or discontinue all or part of the Services without notice. We are not liable for any modification, price change, suspension, or discontinuance. We do not guarantee the Services will be available at all times.

16. GOVERNING LAW

These Terms and your use of the Services are governed by the laws of the State of California, USA, without regard to conflict-of-laws principles.

17. DISPUTE RESOLUTION

Binding Arbitration

If a dispute cannot be resolved informally, it will be resolved by binding arbitration administered by the American Arbitration Association (“AAA”) under the AAA Consumer Rules. Arbitration may be conducted in person, by documents, by phone, or online. The seat and venue of arbitration will be Santa Clara County, California. YOU WAIVE THE RIGHT TO A JURY TRIAL.

Restrictions

Arbitration shall be limited to the parties; no class actions or representative proceedings are permitted.

Exceptions

Claims concerning intellectual property rights, theft, piracy, invasion of privacy, or unauthorized use, and requests for injunctive relief may be brought in court. If a dispute proceeds in court, exclusive jurisdiction and venue lie in the state and federal courts of Santa Clara County, California.

18. CORRECTIONS

Information on the Services may contain errors or omissions. We reserve the right to correct them at any time without prior notice.

19. DISCLAIMER

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. YOUR USE OF THE SERVICES IS AT YOUR SOLE RISK.

20. LIMITATIONS OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL WE OR OUR DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST REVENUE, OR LOSS OF DATA, ARISING FROM YOUR USE OF THE SERVICES.

21. INDEMNIFICATION

You agree to defend, indemnify, and hold us harmless (including our affiliates and personnel) from and against claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from your use of the Services, your Contributions, or your violation of these Terms or applicable law.

22. USER DATA

We may maintain data you transmit for the purpose of operating the Services. You are responsible for all data you transmit and for backing up your data. We are not liable for any loss or corruption of such data.

23. ELECTRONIC COMMUNICATIONS, TRANSACTIONS, AND SIGNATURES

By using the Services, you consent to receive electronic communications from us and agree that all agreements, notices, disclosures, and other communications we provide electronically satisfy any legal requirement that such communications be in writing. You consent to electronic signatures and records for transactions with us.

Opting Out: Reply “STOP” to any SMS to stop receiving messages. You may receive a confirmation message.

26. MISCELLANEOUS

These Terms and any policies posted on the Services constitute the entire agreement between you and us. If any provision is unlawful or unenforceable, that portion is severed and does not affect the remaining provisions. No waiver shall be deemed a further or continuing waiver. We may assign our rights and obligations at any time. We shall not be liable for delays/failures beyond our reasonable control.
